Agreement to Terms
These Terms of Service ("Terms") govern your use of the MyTechSolutions website and services operated by Alberto van Zyl ("MyTechSolutions," "we," "our," or "us").
By accessing our website or engaging our services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access our website or use our services.
Services
MyTechSolutions provides IT consulting and technology services including, but not limited to:

- SaaS Development
- Cybersecurity
Specific services, deliverables, timelines, and pricing will be outlined in a separate service agreement or proposal for each engagement.
Engagement and Pricing
Quotations and Proposals
All quotations and proposals are valid for 30 days from the date of issue unless otherwise specified. Prices are subject to change after this period.
Pricing Structure
Services are typically billed on an hourly basis, with rates depending on the nature and complexity of the work. All pricing is communicated and agreed upon before work commences. We only bill for time actively spent working on your project.
Payment Terms
Payment terms will be specified in individual service agreements. Unless otherwise agreed:
- Invoices are due within 14 days of issue
- For larger projects, a deposit may be required before work begins
- Late payments may incur additional fees and suspension of services
Client Responsibilities
To enable us to provide our services effectively, you agree to:
- Provide accurate and complete information as required
- Provide timely access to systems, data, and personnel as needed
- Make decisions and provide approvals in a timely manner
- Ensure you have the necessary rights and permissions for any materials or systems you provide
- Maintain appropriate backups of your data
- Communicate any concerns or issues promptly
Delays caused by failure to fulfill these responsibilities may impact project timelines and may result in additional charges.
Intellectual Property
Your Content
You retain all rights to your data, content, and materials ("Your Content"). By providing Your Content to us, you grant us a limited license to use it solely for the purpose of providing our services to you.
Our Work Product
Unless otherwise specified in a separate agreement:
- Custom work created specifically for you becomes your property upon full payment
- We retain the right to use general knowledge, skills, and experience gained during the engagement
- We may use anonymized examples of our work for portfolio or marketing purposes unless you request otherwise in writing
Third-Party Materials
Our services may incorporate third-party software, tools, or materials. Such components remain the property of their respective owners and are subject to their own license terms.
Confidentiality
We understand that our work may involve access to sensitive business information. We agree to:
- Keep all confidential information strictly confidential
- Use confidential information only for the purpose of providing our services
- Not disclose confidential information to third parties without your consent
- Implement appropriate security measures to protect your information
Our operations are built on Microsoft 365 with enterprise-grade security, ensuring that all information exchanged is encrypted and secured following industry best practices.
Limitation of Liability
To the maximum extent permitted by law:
- Our total liability for any claims arising from our services shall not exceed the total fees paid by you for the specific service giving rise to the claim
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities
- We are not liable for any delays or failures in performance resulting from circumstances beyond our reasonable control
You acknowledge that IT systems carry inherent risks, and while we implement best practices, we cannot guarantee that systems will be completely free from vulnerabilities, errors, or interruptions.
Disclaimer of Warranties
Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:
- Implied warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
We do not warrant that our services will be uninterrupted, error-free, or completely secure.
Indemnification
You agree to indemnify, defend, and hold harmless MyTechSolutions and its owner from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your use of our services
- Your violation of these Terms
- Your violation of any rights of a third party
- Any content or materials you provide to us
Termination
Either party may terminate a service engagement:
- By mutual written agreement
- With 14 days written notice for ongoing services
- Immediately if the other party materially breaches these Terms and fails to remedy the breach within 7 days of notice
Upon termination:
- You shall pay for all services rendered up to the termination date
- We will provide reasonable assistance in transitioning services
- Both parties shall return or destroy confidential information as requested
Availability
MyTechSolutions operates as a part-time IT freelancing service. While we strive to be responsive, please note:
- Response times may vary based on current workload
- Project timelines are provided based on current availability and are subject to change
- Emergency or urgent requests may be accommodated where possible but cannot be guaranteed
Realistic timelines will always be communicated upfront for any engagement.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the Western Cape, South Africa.
Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services following any changes constitutes acceptance of the new Terms.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms, together with any service agreements or proposals, constitute the entire agreement between you and MyTechSolutions regarding our services and supersede any prior agreements or communications.
